The Law and Mesothelioma

Asbestos has had a long and controversial legal history behind it. Repeatedly it has come into conflict with the law because of the deadly effects it has had and continues to have on human beings. Since asbestos is used as an industrial product, thousands of industrial workers have had their lives destroyed due to sustained exposure to this mineral. Not only industrial workers, but even their families have been and continue to be at risk. The worst thing is, owners of such industrial companies have willingly jeopardized the lives of their employees in the bid for more profit. There have been numerous instances where owners have been fully aware of the presence of asbestos and yet have not taken any safety measures to protect the lives of their employees. Are you one of the victims of such inhuman atrocities? If you are, then it is time for you to stand up for your rights and demand for adequate compensation for all the damage they have done to you and your families.

You can file a lawsuit against the perpetrators or if you want, can do an out of court settlement as well. there are various ways through which you can actually seek legal redressal. For example all army and navy veterans who have suffered form asbestos exposure while serving their country have their own support systems built in.

There is a special kind of lawsuit that you can file and it is called Mesothelioma litigation. His lawsuit is usually brought against companies that supply, manufacture or use asbestos in any form whatsoever. All victims are entitled to compensation because most manufacturers knew about the deadly effects of asbestos as early as the 1930s.

Thus if you have been diagnosed with the disease, then one of the remedies would be to bring the perpetrators to light and make them answer for the horrible crime that they have committed. Thousands and thousands o workers have died as a result of such callous negligence on the part of the manufacturers. Not only workers, even the people close to them have contracted the disease and died as well. There have been many legal debates about this, especially in the American Congress but successive legislations have done little to nothing to alleviate the cause.

What Is The Next Step After Diagnosis?

If you are a mesothelioma victim then there is long fight ahead of you. It will probably be a hard struggle but then if you do the right thing at the right time, then you can emerge the winner in the battle ahead of you. The battle doesn't end with your diagnosis, rather it is just the beginning. The first step that you MUST take after diagnosis is choose an attorney. You must be extremely careful in your choice of mesothelioma attorney. Asbestos litigation is proving to be one of the most prolific areas in specialised litigation in modern times. However, there are different asbestos related conditions and all of them are not necessarily cancerous. Therefor there is a difference between an asbestos attorney and a mesothelioma attorney. It is a wiser step if you choose a mesothelioma attorney rather than a generalized attorney because the latter will give you individualized attention and will also have specialised legal expertise which will be instrumental in winning your case. Also the mesothelioma law firms will have better experience and expertise at trial as well as arranging for suitable settlements. This is providing that your case is a single plaintiff case.

There are certain technicalities that you must keep in mind, and you must always keep track of these factors in your case. Make sure that your attorney is experienced and knowledgeable about statute-of-limitation laws which apply in your case. Also, do some background research and find out whether your mesothelioma law firm has any agreement with certain famous asbestos companies. If the two are in league then there are chances that your settlement might not be as favourable. I think that the entire purpose of fighting a case is negated if the people who are helping you fight the case have agreements with the very corporations that you are trying to bring to light for their inhuman negligence.

Also, clarify whether your suit will be tried separately or as a class-action lawsuit. Another important technicality that you must be aware of is the jurisdiction where your case will be tried. There might be different states involved, and as a consequence, different laws. Finally, to make sure that your problem is in genuine hands, always ask for references from other mesothelioma patients who have used the same firm or attorney for their own lawsuits.

The Staging Systems of Mesothelioma

Cancer has always been treated by doctors in terms of stages. Each stage is used by the doctors to determine how to treat a particular cancer and ways to go about its prevention. Thus mesothelioma also has special staging systems that help the doctors to diagnose the extent of the disease in terms of particular stages. Since pleural mesothelioma is the commonest of all forms of mesothelioma, there are certain formal staging systems that are set in place to treat pleural mesothelioma. But however, since the other forms of mesothelioma are not that common, therefore there aren’t any formalized staging systems in place yet.

The Buchart System is the oldest staging system for pleural mesothelioma. This system has been based on the size of the tumor. It divides the diagnosis into four stages. This basically tracks the growth of mesothelioma from the pleural lining in the lungs to the stomach, lymph nodes, abdominal cavity and then finally the bloodstream and other main organs.

The second system is called the TNM System and is the modern staging system that is used for treating malignant mesothelioma. This, unlike the Buchart System is based on the level of growth of the tumor and the involvement of the lymph node as well. this too divides the growth of malignant mesothelioma in four stages. This system checks the metastasizing of the tumour.

The third staging system for malignant mesothelioma is called the Brigham System and is the most developed system among the three. This not only takes into consideration the involvement and extent of the lymph nodes but also other factors like whether like whether it is surgically viable and possible to operate on a malignant tumour and remove it. This quality is called resectability. Since malignant or pleural mesothelioma is rarely operable the Brigham system is not used to stage mesothelioma. It divides the disease into four stages as well. Firstly it judges as to whether the tumour is still resectable or operable at all and whether the lymph nodes are affected. The second stage decides whether the tumour is resectable while the lymph nodes have been affected. The third stage diagnoses the fact that the tumour is not operable and has metastasized while the last stage decides as to how the tumour is completely inoperable and has spread throughout the body. That stage is also called complete metastasizing.

Symptoms of Mesothelioma

Mesothelioma is a form of aggressive cancer that affects people who have had a long history of exposure to a mineral called asbestos, either directly or indirectly. Asbestos was widely used as an industrial substance especially after during the 19th century till as recently as the Second World War. Thus not only industrial workers but even their families contracted mesothelioma and died by the thousands. The worst thing about mesothelioma is the fact that it is a very slow developing cancer in the sense that the symptoms of mesothelioma begin to appear in the patient after about 20 to 50 years from the time of exposure. There it is very difficult to detect mesothelioma at an early stage of development. However, newer therapies are being developed each day, to find out ways through which mesothelioma can be discovered at a earlier stage.

There are various types of mesothelioma depending on which organ is affected. However the most common form is pleural mesothelioma where the lining of the lungs is affected. Signs which are usually observed in mesothelioma patients are:

  1. pain in the chest wall
  2. A fluid which surrounds the lung. This is called pleural effusion.
  3. Increasing shortness of breath.
  4. Exhaustion prone and anaemic tendencies
  5. Wheezing coughs
  6. Presence of blood in the sputum which is being coughed up
  7. Loss of weight.

In the case of severe mesothelioma the patient can develop many tumours. The lung may collapse, a condition which is known as pneumothorax. The mesothelioma often spreads to other parts of the body. This spreading is called metastasizing. Again, a severe case of mesothelioma may display the following symptoms:

  1. Blood clots in the veins, causing thrombophlebitis.
  2. Excessive bleeding in many of the organs
  3. Yellowish tinge of the eyes and skin, which leads to jaundice.
  4. Low blood sugar levels
  5. Blood clots in the arteries of the lungs. This condition is called pulmonary emboli.
  6. Case of ascites in which fluid is created and stored in the abdominal cavity.
  7. Pleural effusion or a build up of fluids in the lungs. The shortness of breath usually occurs because of pleural effusion.
Mesothelioma does not usually spread to certain parts of the body like the bones, the brain or the adrenal glands. The tumours are usually found only on one side of the lungs.

How to Make The Right Choice

Mesothelioma litigation is a very complex and long drawn out legal process. Thus when you choose a mesothelioma attorney you have to make sure that you are choosing the right professional who will represent you interests in the best way possible and get you the best possible settlements that can be awarded. But then again, it is one thing to tell one to make a right choice and quite another thing to make one. Therefore, before choosing your specialised mesothelioma attorney or mesothelioma specialty law firm there are certain factors that you must clarify, because remember, these people are going to charge you so make sure you get the best out of them.

Firstly, the best way to get contacts for a good mesothelioma lawyer is through word of mouth. talk to people in your personal as well as professional circles. These things almost always work through reputation and therefore look around for a contact who has been of use in similar cases before. Once that task is completed you need to start doing your own evaluation as well. First of all, you need to find out the amount of experience the firm has in handling cases concerning mesothelioma. Experience is all important in this matter. Also, do not just look at the number of cases, but also the kind of cases they have worked on. Ask your attorney if he has worked on cases similar to yours. Remember that all cases are unique in one way or the other. now comes one of the most important and clinching factors.Ask your attorney as to how many cases have they actually taken to trial and the kind of verdict that they have received. Also, ask them about whether these verdicts were obtained by another law firm or theirs exclusively.

Another question that you need to ask is whether an attorney from the chosen law firm will represent you at the trial or would you have to hire another attorney externally? Lastly you need to find out whether the firm will continue to handle your case in case there is an appeal. The experience that the firm has in handling appellate cases is vital and you should also take a check into their track record and see whether they have successfully handled such appellate cases or not.

Keeping these important factors in mind make your choice of legal defense and go ahead.
